Former Airports Fiji Limited chief executive’s lawyer Devanesh Sharma today questioned why the Fiji Independent Commission Against Corruption (FICAC) kept amending charges against his client.
Sharma also questioned why a crucial evidence was submitted to the court only after defence raised concerns in their submission.
He questioned why disclosures were submitted late, since the witness, then Manager Finance, AFL, had said in his caution statement that there was no policy in place by the AFL board of directors governing the use of the company credit card.
According to Sharma, this evidence was only brought up recently after he raised that the two other witnesses were not the only ones that had powers when it came to the use of the company credit card.
FICAC lawyer Madhawa Tennakoon objected to the stay application and said there was no such abuse of the process of the court system.
Tuisolia faces a charge of abuse of office and fraudulent conversion.
FICAC alleges the incident occurred while the accused was the CEO for AFL from 2003 to 2006.
A decision on the stay order application is expected on March 19.
