Mobile phone service operator Digicel Fiji has been ordered by the High Court to pay $800 to Dickson International Trading Company Limited.
This after an interim injunction sought by them was denied last week.
The interim injunction was to stop Dickson from allowing Digicel customers to break their contracts by having their phones unlocked and have them replaced with Vodafone sim cards.
Lautoka High Court judge Justice Sosefo Inoke ruled that Digicel does not own mobiles sold to its customers and that its rights are purely contractual.
Justice Inoke also ruled that Digicel has the right to defend and has been given until March 1, 2010 to file its defence.
Meanwhile court costs to Dickson International should be paid within 14 days.
