An application for a fresh trial has been made for a father who assaulted his teenage son’s teacher following a change in magistrates.
Chandrika Prasad was charged with assault in 2007 after he assaulted Roniel Lal, a volunteer teacher at the Fiji Society for Blind School in Vatuwaqa.
This after Prasad alleged that Lal had tortured and sexually assaulted his 14-year-old disabled son.
The alleged incident took place in July 2007 after his son came home and told him his teacher had forced him to eat chillies and later sexually molested him when he had gone to the washroom.
Defence lawyer Rajendra Chaudhry told the court he would be making applications for a fresh trial as the magistrate had changed.
Magistrate Elsie Hudson will preside over the matter.
Hudson has allowed Chaudhry 14 days to file an application and another 14 days for the prosecution to reply.
The case will now be called on August 17.
